Personal Injury Claims Process

We will explain the entire personal injury claims process. Because no two cases are the same, this is only a brief and generic description of the process.

Initial consultation

Even if you believe your case is straightforward, you can take advantage of a free initial consultation. Provide your lawyer with all the details and important information about the case. At Dubo Law, we will work for our client’s best interests. We strive to provide honest advice and respect the wishes of our clients.

Filing a claim

Attorney will notify the insurance company of your intention to make a claim by sending an official notification letter. The insurance company will then know that you have a legal representation and that all future communication will be with the attorney’s office. Your attorney will also file a claim with your own insurance company to ensure you receive your Personal Injury Protection benefits and pursue a claim for Uninsured/Underinsured Coverage if needed.

Investigation and gathering evidence

The next step is gathering information and evidence related to the accident. This usually includes reviewing your medical records, police reports, video footage, and witness information. This stage will help the injury lawyer get the full picture of what happened, who is at fault, and the full extent of the damages you sustained, so it can be crucial to ensuring a beneficial outcome for your case.

Settlement negotiations

In most cases, an attorney will wait until you reach the maximum medical improvement level (MMI) before proceeding with the case. MMI means that you either end your treatment or have physically recovered as much as possible. Your attorney will then gather all the medical records and bills to submit them to the insurance company as part of the settlement packet. Settlement discussions normally go back and forth with the insurance adjuster several times because the insurance company will not agree to your initial demands in the majority of cases. In this stage, the active participation of the client is important. At Dubo Law, we frequently explain to our clients that this is their case and their active participation is crucial. Suppose an insurance company is not willing to make a fair offer. In that case, we always recommend to our clients filing a lawsuit. Even if you eventually file a lawsuit against the liable party, very few lawsuits actually get to the courtroom. Most settle before trial, often in mediation.

Litigation

If mediation or settlement negotiations do not work, a lawsuit will be filed on your behalf. All the parties will be engaged in ‘discovery,’ which will enable the lawyers to find out as much as possible about the other side’s position. As a part of the pre-trial phase, the discovery phase is the formal process of exchanging information between the parties about the witnesses and evidence they will present at trial. Discovery enables the parties to know before the trial begins what evidence may be presented. During this process, each side will gather information, request answers, and provide responses of their own. It is not uncommon that during this process, many cases actually settle. Having an attorney that conducts a thorough discovery usually places you in a position of getting a better settlement offer.

Trial

If no settlement is reached, the case will eventually go to trial. Having one of the most experienced Lutherville-Timonium personal injury attorneys, Neil Dubovsky, will increase your chances of obtaining a beneficial outcome at trial. Whether your case is in District Court or Circuit Court, the process is fairly similar. Plaintiff presents the case with evidence in the form of documents and witness testimony. Each witness called by the plaintiff will be subject to cross-examination by the other attorney. Then, the defense will also present its case, including documents and witnesses. Each witness will also be subject to cross-examination. After both sides have presented their cases, the attorneys will make their closing arguments. The case will then be presented to the Judge or Jury for resolution. They will then award the plaintiff an amount in damages they think to be reasonable and fair – it will include damages for physical injuries, lost wages, and pain and suffering.

Types of Damages in Personal Injury Cases

In the American legal system, damages are intended to compensate the plaintiff sufficiently to make them “whole,” or to restore the plaintiff to the same position they were in before the injury or accident. There are four types of damages you are entitled to:

Economic damages

Cover the cost of medical bills, loss of income and benefits, personal care costs, and modification of your home or vehicles due to permanent disability.

Non-economic damages

These damages include pain and suffering, permanent impairments and disabilities, loss of quality of life or enjoyment of life.

Punitive damages

These damages are available only in a few types of personal injury cases. It is awarded to ‘punish’ the responsible party and deter the party from engaging the similar conduct in the future. The victim must prove that the responsible party acted with malice, wantonness, willful misconduct, oppression, fraud, or conscious indifference to the consequences of their actions. Examples may include impaired driving accidents, nursing home abuse, and injuries caused by assault.

Property damage

They are separate from personal injury claims. It covers the replacement or repair of the damaged property during the accident (for example, a vehicle, cell phone, car seat, etc.). The value of a property damage claim is based on the current fair market value of the item or the amount of the repairs.

Calculating the Value of Personal Injury Damages

The value of your personal injury claim depends on numerous factors, including:

  • The type and severity of injuries you suffered,
  • The amount of pain you experienced,
  • The length of your recovery,
  • The past and future lost wages and medical expenses,
  • Costs to repair or replace damaged property,
  • The amount of available insurance,
  • How your pain and suffering from the injuries have impacted your life.

When necessary, the lawyer may consult the medical and financial professionals to offer expert testimony regarding the value and extent of your damages, including future damages.

The Statute of Limitations Personal Injury Cases

This refers to the limited period of time within which you can file a lawsuit or an insurance claim. The statute of limitations on personal injury claims in Maryland is three years. This period begins to run from the ‘date of discovery,’ which is the earliest date the plaintiff actually knew or should have realized that they had a personal injury claim.
